Two-Year Limited Warranty

What this Limited Warranty covers

Seeds

Baker Creek warrants that the seeds you buy from us will, when properly stored,
planted, and cared for: (1) germinate at reasonable rates for two years from the date you
buy them from us, and (2) grow true to type. Baker Creek disclaims all other warranties.


Merchandise

Baker Creek warrants that the merchandise you buy from us is free from defects in
material and workmanship. Baker Creek disclaims all other warranties.

What this Limited Warranty does not cover

Seeds

This Limited Warranty does not cover damage to seeds caused by the failure to store them
in a cool, dry, dark place. Baker Creek does not warrant how productive the plant that
grows from a seed may be because this may be affected by variables outside our control,
including weather, soil composition, light, and pests. This Limited Warranty also does not
cover damage to seeds or plants caused by the gardener, weather, acts of God, people, or
animals.

Merchandise

This Limited Warranty does not cover damage to merchandise caused by attempts to
modify or alter the product.

How long this Limited Warranty coverage lasts

This Limited Warranty lasts for two (2) years from the original date of purchase of
the product from Baker Creek Seed Company. The duration of any warranty that
may be implied in law, if any, is also hereby limited to two years.

Who is covered by this Limited Warranty

This Limited Warranty covers only the original purchaser of the product. This Limited
Warranty is not transferrable to subsequent owners or purchasers of the product.

How to obtain service under this Limited Warranty

We value satisfied customers. If the seeds or merchandise you bought from us fails to meet
the Limited Warranty, please tell us the details at: warranty@rareseeds.com, or by mail at
Warranty, Baker Creek Heirloom Seeds, 2278 Baker Creek Rd., Mansfield, MO 65704.
Where possible, we will ask you to return the product to us. For seeds where that may not
be possible, we may ask you for pictures. We are not responsible for the shipping costs of
any product returns. The buyer’s failure to return the product upon our request voids this
warranty.

What Baker Creek will do

Once you submit a warranty claim, we will evaluate it promptly. If we determine that the
product does not meet our Limited Warranty, we may, at our sole discretion:

  • Repair the merchandise,
  • Replace the seeds or merchandise, or
  • Refund the purchase price of the seeds or merchandise.

Baker Creek will not be responsible for more than the amount paid for the product.

No other express warranty applies

This Limited Warranty is the sole and exclusive express warranty. We make no other
warranties that extend beyond this Limited Warranty.

No Baker Creek employee or agent is authorized to alter this Limited Warranty or to make
any other warranty on behalf of Baker Creek. Your decisions about how, where, and when
to plant seeds are yours alone, and conversations with customer service representatives
shall not create express warranties different from this limited warranty.

Limitation on liability

Liability under this Limited Warranty is limited to replacement of the product or refund of
the purchase price. Baker Creek shall not be responsible for incidental or consequential
damages. Under no circumstances will Baker Creek be responsible for more than the
purchase price of the product. Baker Creek is not responsible for labor or effort the buyer
may have spent tending seeds.

This warranty gives you specific legal rights, and you may have other legal rights that vary
from state to state. Some states and countries do not allow the limitations or exclusions of
relief; incidental, consequential, or indirect damages; or the limitation of liability to special
amounts. So the above limitations may not apply to you.
